A lo largo de la historia, diversas han sido las funciones sociales que ha desarrollado el cine más allá de sus faceta lúdica basada en el entretenimiento. Entre estas funciones destacan su capacidad para registrar hechos históricos fundamentales, su gran eficacia como herramienta de publicidad o propaganda, su facultad a la hora de interactuar con otras disciplinas artísticas, su capacidad de educar y sensibilizar a la sociedad, su facultad ética o filosófica o su faceta informativa.

El texto se aproxima a la renovada hermenéutica jurídica de los inicios del siglo xix alemán, un periodo y un lugar anticodificador, antiiusnaturalista: “historicista” (geschichtlich). Adjetivos de un siglo con un derecho positivo que no crea el legislador, sino que es herencia del pasado, ratio scripta: derecho romano “actual” o heutiges römisches Recht. Entre las estrategias “jurídicas” empleadas en la época para legitimar la vigencia del viejo derecho romano, nos interesa sobre todo una: la interpretación. La hermenéutica jurídica renace a (...) medida que la mentalidad histórica se introduce en el ámbito de las ciencias del espíritu. Pero una aproximación detenida a la idea “pandectística” de la interpretación, apoyada en los textos de los autores de esta corriente, desmiente la visión “conceptualista” que se asocia al periodo de la famosa Begriffsjurisprudenz. En la revisión de esta visión tradicional nos detenemos en el caso de Georg Friedrich Puchta, sucesor del maestro Savigny. El “heutiges” derecho romano, para volverse “actual”, debía ser modificado en aquello que según las necesidades del Volksgeist fuese necesario, y la labor interpretativa del jurista enseña en ocasiones una labor constructiva que no es compatible con el “formalismo” que la historiografía tradicional atribuye a la ciencia del derecho de la Escuela histórica del Derecho. We give two social aggregation theorems under conditions of risk, one for constant population cases, the other an extension to variable populations. Intra and interpersonal welfare comparisons are encoded in a single ‘individual preorder’. The theorems give axioms that uniquely determine a social preorder in terms of this individual preorder. The social preorders described by these theorems have features that may be considered characteristic of Harsanyi-style utilitarianism, such as indifference to ex ante and ex post equality. However, the theorems are (...) also consistent with the rejection of all of the expected utility axioms, completeness, continuity, and independence, at both the individual and social levels. In that sense, expected utility is inessential to Harsanyi-style utilitarianism. In fact, the variable population theorem imposes only a mild constraint on the individual preorder, while the constant population theorem imposes no constraint at all. We then derive further results under the assumption of our basic axioms. First, the individual preorder satisfies the main expected utility axiom of strong independence if and only if the social preorder has a vector-valued expected total utility representation, covering Harsanyi’s utilitarian theorem as a special case. Second, stronger utilitarian-friendly assumptions, like Pareto or strong separability, are essentially equivalent to strong independence. Third, if the individual preorder satisfies a ‘local expected utility’ condition popular in non-expected utility theory, then the social preorder has a ‘local expected total utility’ representation. Fourth, a wide range of non-expected utility theories nevertheless lead to social preorders of outcomes that have been seen as canonically egalitarian, such as rank-dependent social preorders. Although our aggregation theorems are stated under conditions of risk, they are valid in more general frameworks for representing uncertainty or ambiguity. (shrink)

A mixture preorder is a preorder on a mixture space (such as a convex set) that is compatible with the mixing operation. In decision theoretic terms, it satisfies the central expected utility axiom of strong independence. We consider when a mixture preorder has a multi-representation that consists of real-valued, mixture-preserving functions. If it does, it must satisfy the mixture continuity axiom of Herstein and Milnor (1953). Mixture continuity is sufficient for a mixture-preserving multi-representation when the dimension of the mixture space (...) is countable, but not when it is uncountable. Our strongest positive result is that mixture continuity is sufficient in conjunction with a novel axiom we call countable domination, which constrains the order complexity of the mixture preorder in terms of its Archimedean structure. We also consider what happens when the mixture space is given its natural weak topology. Continuity (having closed upper and lower sets) and closedness (having a closed graph) are stronger than mixture continuity. We show that continuity is necessary but not sufficient for a mixture preorder to have a mixture-preserving multi-representation. Closedness is also necessary; we leave it as an open question whether it is sufficient. We end with results concerning the existence of mixture-preserving multi-representations that consist entirely of strictly increasing functions, and a uniqueness result. (shrink)

SummaryThis article presents the development and current situation of the sociology of sport in Spain. It begins with a brief description of its origins and development as an academic field, which can be divided into three stages: birth, growth, and consolidation and internationalization. It then describes the theoretical and methodological traditions as well as the predominant topics (including the most representative research) in the social scientific studies on physical activity conducted so far in Spain. The main topics have been sports (...) in society, sports controversies, the social sports structure, sports identities and spaces for practicing sports, organization, management, and the job market. The article concludes with an analysis of the possible future challenges for the sociology of sport in Spain and the role that the journal Sociología del Deporte (Sociology of Sport) can play in view of these challenges. The philosophical interest in experimental practice in neuroscience has brought renewed attention to the study of the development and use of techniques and tools for data production. John Bickle has argued that the construction and progression of theories in neuroscience are entirely dependent on the development and ingenious use of research tools. In Bickle's account, theory plays a tertiary role, as it depends on what the tools allow researchers to manipulate, and the tools, in turn, are developed not in order (...) to test theories but as solutions to engineering problems. However, Bickle's account is not entirely precise in explaining what informs researchers' decision-making in their atheoretical laboratory tinkering. Identifying the sources that guide researchers in tool development and use is crucial if one wishes to contribute to the philosophical or meta-scientific understanding of experimental practice in neuroscience. In the following paper, I claim that decision-making in tools' development and use in neuroscience is doubly guided. Pre-existing theory and concepts determine information's relevance, whereas tools' functioning in controlled situations determines information's reliability. Accordingly, experimenters' decision-making is situated both in the context of analysing, modelling or interpreting information and in the context of producing information. I study the case of the tungsten microelectrode developed by David Hubel during the 1950s. First, I show that pre-existing theory and concepts determine in advance what information would be relevant to obtain from the microelectrode. Second, I show that Hubel's tinkering follows the guidelines derived from the very structure of what we recognise as reliable experimentally produced information. Finally, I suggest that data-production processes allow experimenters to assess what to expect from an experimental system in terms of concept- and theory-generation and confirmation, thereby endorsing Bickle's tenet on the tertiary role of theory in neuroscience. The increasing application of artificial intelligence (AI) to healthcare raises both hope and ethical concerns. Some advanced machine learning methods provide accurate clinical predictions at the expense of a significant lack of explainability. Alex John London has defended that accuracy is a more important value than explainability in AI medicine. In this article, we locate the trade-off between accurate performance and explainable algorithms in the context of distributive justice. We acknowledge that accuracy is cardinal from outcome-oriented justice because it helps (...) to maximize patients’ benefits and optimizes limited resources. However, we claim that the opaqueness of the algorithmic black box and its absence of explainability threatens core commitments of procedural fairness such as accountability, avoidance of bias, and transparency. To illustrate this, we discuss liver transplantation as a case of critical medical resources in which the lack of explainability in AI-based allocation algorithms is procedurally unfair. Finally, we provide a number of ethical recommendations for when considering the use of unexplainable algorithms in the distribution of health-related resources. (shrink)

Background: This research explores how public awareness and attitudes toward donation and transplantation policies may contribute to Spain's success in cadaveric organ donation. Materials and Methods: A representative sample of 813 people residing in Andalusia (Southern Spain) were surveyed by telephone or via Internet between October and December 2018. Results: Most participants trust Spain's donation and transplantation system (93%) and wish to donate their organs after death (76%). Among donors, a majority have expressed their consent (59%), and few nondonors have (...) expressed their refusal (14%). Only a minority are aware of the presumed consent system in force (28%) and feel sufficiently informed regarding the requirements needed to be an organ donor (16%). Participants mainly consider that relatives should represent the deceased's preferences and be consulted when the deceased's wishes are unknown, as is the case in Spain. Conclusion: Public trust in the transplant system may contribute to Spain's high performance in organ donation. High levels of societal support toward organ donation and transplantation do not correspond with similar levels of public awareness of donation and transplantation policies in Spain. (shrink)

Los últimos avances de la ciencia invitan a pensar en la posibilidad práctica del transhumanismo. Pero quizá es pertinente estudiar una pregunta a la que todavía ni la ciencia ni la filosofía han sabido dar respuesta. En concreto, la naturaleza de la consciencia fenoménica de Ned Block o del concepto de vigilancia de Stanislas Dehaene. Pese a los últimos avances en neurociencia y en inteligencia artificial, seguimos sin pistas para responder a la pregunta del problema fuerte de la consciencia de (...) David Chalmers, del como y por qué estamos aquí. Somos capaces de discriminar de que información somos conscientes, pero no hemos conseguido averiguar por qué somos conscientes o como se genera esa consciencia. El problema es mas grave de lo que parece, ya que no somos capaces de medir, definir ni replicar la consciencia fenoménica. Sin medición, si el objeto de estudio es subjetivo y cualitativo, no se puede aplicar el método científico. Luego, pese a que podríamos replicar la información de nuestro cerebro en un artefacto mecánico, nada garantiza que nuestra consciencia fenoménica se replique ahí, ya que no podemos medir la consciencia fenoménica. Este artefacto hecho a imitación nuestra podría no ser mas que un zombie filosófico, en palabras de David Chalmers, un ser sin consciencia fenoménica, un ser sin alma. Ante esta realidad, cabe preguntarnos: ¿es seguro explorar la alternativa de trascender en un sistema independiente de nuestro cerebro biológico, como un ordenador, sino tenemos ninguna herramienta para medir si ese sistema puede ser consciente de si mismo o producir consciencia fenoménica como un epifenómeno? Si la respuesta, como se defiende en este trabajo, es negativa, una alternativa mas segura para el transhumanismo es explorar la ingeniería genética, los implantes artificiales o embeber el cerebro en sistemas artificiales. Given the ubiquitous nature of love, numerous theories have been proposed to explain its existence. One such theory refers to love as a commitment device, suggesting that romantic love evolved to foster commitment between partners and enhance their reproductive success. In the present study, we investigated this hypothesis using a large-scale sample of 86,310 individual responses collected across 90 countries. If romantic love is universally perceived as a force that fosters commitment between long-term partners, we expected that individuals likely to (...) suffer greater losses from the termination of their relationships—including people of lower socioeconomic status, those with many children, and women—would place a higher value on romantic love compared to people with higher status, those with fewer children, and men. These predictions were supported. Additionally, we observed that individuals from countries with a higher (vs. lower) Human Development Index placed a greater level of importance on romantic love, suggesting that modernization might influence how romantic love is evaluated. On average, participants worldwide were unwilling to commit to a long-term romantic relationship without love, highlighting romantic love’s universal importance. (shrink)

ObjectiveTo compare techniques for computing clustering and switching scores in terms of agreement, correlation, and empirical value as predictors of incident cognitive impairment.MethodsWe transcribed animal and letter F fluency recordings on 640 cases of ICI and matched controls from a national epidemiological study, amending each transcription with word timings. We then calculated clustering and switching scores, as well as scores indexing speed of responses, using techniques described in the literature. We evaluated agreement among the techniques with Cohen’s κ and calculated (...) correlations among the scores. After fitting a base model with raw scores, repetitions, and intrusions, we fit a series of Bayesian logistic regression models adding either clustering and switching scores or speed scores, comparing the models in terms of several metrics. We partitioned the ICI cases into acute and progressive cases and repeated the regression analysis for each group.ResultsFor animal fluency, we found that models with speed scores derived using the slope difference algorithm achieved the best values of the Watanabe–Akaike Information Criterion, but with good net reclassification improvement only for the progressive group. For letter fluency, different models excelled for prediction of acute and progressive cases. For acute cases, NRI was best for speed scores derived from a network model, while for progressive cases, the best model used clustering and switching scores derived from the same network model. Combining variables from the best animal and letter F models led to marginal improvements in model fit and NRI only for the all-cases and acute-cases analyses.ConclusionSpeed scores improve a base model for predicting progressive cognitive impairment from animal fluency. Letter fluency scores may provide complementary information. (shrink)

La hipótesis mimética es una teoría antropológica formulada por el pensador René Girard según la cual la esencia del deseo humano se caracteriza por una imitación paradójica y ambivalente, capaz de generar efectos de signo contrario. El pensador Peter Sloterdijk ha elaborado su obra bajo los presupuestos de esta hipótesis antropológica aunque sea de forma polémica. De hecho, funda en ella no sólo su fenomenología del espacio afectivo sino también su crítica al psicoanálisis y su análisis de la sociedad post-industrial (...) de masas. UNESCO in the 2030 agenda for sustainable development establishes respect for the environment and sustainability education as key elements for the challenges of society in the coming years. In the educational context, physical education can have a vital role in sustainability education, through Traditional Sporting Games. The aim of this research was to study from an ethnomotor perspective the different characteristics of two different groups of TSG in the Canary Islands, Spain. The corpus of this investigation was made up of (...) 513 TSG, identified by two analysis techniques and collected in a database. The categories corresponding to the variables of the internal logic of the game were the type of motor interaction, related to space, relationships with time, and relationships with objects. The study also examined the variables of external logic or sociocultural conditions such as the protagonists, playing areas, and game moments. The data analysis was carried out using descriptive and inferential statistics: cross-tables, effect sizes, classification trees, and the identification of frequency areas. Of the total number of playful activities identified, most were physical activities. These activities were Quasi-games without rules and TSG as well as activities with Objects and without material. This research confirms that the TSG in the Canary Islands is a mirror of traditional culture and, from a pedagogical approach, shows great potential for material and social sustainability. (shrink)

ABSTRACT The problem of “scotopic vision”, or vision under conditions of partial or total darkness, is one of the most enigmatic and least studied topics in Aristotelian psychology. In the article we present the exegesis of Averroes on this matter. We point out a dificulty that arises in the Great Commentary around some terms used to designate the obscurity in the whole of the theory. We propose as a solution a moderate interpretation of the matter, in accordance with the “principle (...) of economy” and the traditional exegesis of the commentators. (shrink)

Los recientes estudios historiográficos sobre la idea de “perdón” han aportado datos valiosos sobre este término de la filosofía académica. Su uso mundano expresa una mentalidad y unas prácticas socialmente regladas muy específicas. Los resultados de esta investigación permiten afirmar que dicha noción existía en el seno de la sociedad greco-romana, de manera que el “perdón al enemigo” no es una innovación total de la cultura judeo-cristiana, sino más bien una consecuencia de la previa romanización. La crítica contemporánea ha mostrado el contraste entre la teoría de la visión expuesta en los libros I y III de Meteorológicos y el resto de obras mayores del corpus aristotelicum. En este artículo presentamos una clasifi cación de las principales interpretaciones arrojadas sobre esta irregularidad. Finalmente, propondremos una exégesis de estos pasajes acorde con la teoría estándar establecida por Aristóteles en las obras psicológicas.

La obra de René Girard logra aunar, desde la tradición realista, las corrientes moderna y postmoderna. Su teoría del deseo mimético da lugar a una síntesis que supera el nihilismo y el fundamentalismo propio de estas tradiciones en favor de la tradición clásica.

Painted in 1656 by Diego Velasquez (1599-1660), Las Meninas has engendered countless philosophical commentaries. Artists, too, have explored the painting's puzzles and paradoxes. All of the responses to this masterpiece, now over 350 years old, show that Las Meninas continues to live with us on several levels. Indeed, Las Meninas is one of the most controversial paintings of our time (Brown and Garrido, 1998, p. 181); no small feat given that cutting-edge art today is often media-based and/or media-driven. The (...) wealth of controversy has generated so much material since the work's conception that James Elkins, in his book Why Are Our Pictures Puzzles, characterized Las Meninas as an artwork that has become monstrous. According to Elkins, it has effectively outgrown the discipline of art history. Like the frescos in the Brancacci Chapel, the Mona Lisa, Raphael's School of Athens and the Oath of Horatio by David, the scholarship surrounding Las Meninas is so vast that no single thinker or volume can present it fully; it is not even possible to teach these works in a yearlong seminar (Elkins, 1999). While I am among those captivated by the painting, I am also aware of how little a short essay can accomplish. Nevertheless, I do hope to convey why this immense canvas continues to inspire people creatively, intellectually, and passionately. In terms of consciousness, my comments are intended to weave the physicality of the work with epistemological interpretations and empirical investigations so that its mutability is more present in our consciousness discourse. In a logically perfect language the oxymoron ‘the numbers 3 and 2+1 are the same number’ could not be said. Likewise, ‘the number 3 and the number 2+1 are one number’ is just as bad from a logical point (...) of view. In normal English these two sentences are idiomatically taken to express the true proposition that ‘the number 3 is the number 2+1’. Another idiomatic convention that interferes with clarity about equality and identity occurs in discussion of numbers: it is usual to write ‘3 equals 2+1’ when “3 is 2+1” is meant. When ‘3 equals 2+1’ is written there is a suggestion that 3 is not exactly the same number as 2+1 but that they merely have the same value. Jorge Oteiza (1908-2003) dio escasas pistas sobre su estancia en Argentina, Chile y Colombia entre 1935 y 1948. Este artículo desarrolla un análisis de la evolución de sus ideas estéticas a la luz de un cotejo de sus publicaciones de las décadas de 1940, 1950 y 1960 y la documentación personal del artista conservada en el archivo y la biblioteca de la Fundación Museo Jorge Oteiza (Alzuza, Navarra). Se presta especial atención a la relación de Oteiza con diversos artistas americanos (...) y del exilio español, en un tejido en cuyo centro se encontraría en muchas ocasiones el poeta Vicente Huidobro. En particular, se analiza su encuentro con poetas como Pablo de Rokha, Pablo Neruda y Juan Larrea, así como su estudio del arte precolombino y su recepción del muralismo de David Alfaro Siqueiros y el constructivismo de Joaquín Torres García, que lo llevarían a proponer un cambio de paradigma cultural, en los albores de la posmodernidad, en diálogo con el indigenismo y el poscolonialismo. In lieu of an abstract, here is a brief excerpt of the content:Theory of the Apophantic Judgment According to René GirardDesiderio Parrilla Martínez (bio)introduction: criticism of judgment in rené girardIn his essay "Belief (Cultural Memory in the Present)" ("Credere di credere") Gianni Vattimo stated the conditions of possibility of a "weak and post-metaphysical Christianity" founded in René Girard´s victimary hypothesis.1 According to Vattimo, mimetic theory allows abandoning traditional metaphysics and the classical theory of truth, based on the judgment. In (...) later works, Vattimo insisted on the epistemological virtues of mimetic theory to reform the classical theory of adequacy2 and the theological implications of this reform.3 Mimetic theory definitely unmasks the violence of the "strong metaphysic," to enable the advent of a weak metaphysics and a kenotic theology based on love: "According to him, it is the survival of the victim-based mechanism, albeit in attenuated form, that explains the recurrence of violence in the history of Christianity. To complete Girard's argument, we learn from Heidegger that what Girard calls the victim-based mechanism is metaphysical objectivism."4 The Erlebnis (non-conceptualized experience) of this theological weakening [End Page 147] has occurred as an event from a previous epistemological weakening, which mimetic theory itself contributes to consolidating.5This drift toward the epistemological nihilism generated a debate between Gianni Vattimo and René Girard, who rejected this conclusion drawn from his mimetic theory.6 The transcript of this controversy first appeared in Verità o fede debole? Dialogo su cristianesimo e relativismo (2006) [Christianity, Truth, and Weakening Faith (2011)], a compilation of three dialogues on three fundamental concepts: truth, secularization, and relativism. In the first part, focused on the epistemological question of truth, Girard affirms he isn't accurately recognized in Vattimo´s thought, showing his distance and warning that, unlike the Italian thinker, his thinking is primarily realistic: "Personally, I agree with Vattimo when he says that Christianity is a revelation of love, but I do not exclude that it is also a revelation of truth. Because truth and love coincide and are one in Christianity."7 In the same chapter, Vattimo challenges René Girard for not having extracted the ultimate consequences of his mimetic theory, because he stays trapped in the realistic ontology of a pre-mimetic mentality: [Vattimo:] "In sum, the only thing I really can't go along with in Girard is his faith in the salvific power of truth, whether it be revealed or discovered by science."8However, in the controversy René Girard could not fail to recognize the central thesis of Gianni Vattimo, according to which his work involved a critique of the classical interpretation of judgment: "I think that there is some kind of incompatibility between traditional philosophy and mimetic theory. I feel, for instance, that scholars influenced by Thomism are handicapped in regard to mimetic theory, because they have to work with neatly distinguished categories. Philosophy is looking for logical foundation as well. It is difficult for philosophers to accept a mechanism that triggers opposite effects. Therefore, it always excludes the real anthropological foundation."9 René Girard acknowledges that in his eagerness to keep up the anthropo-genesis, he cannot avoid judging the theory of judgment from the mimetic theory.10 This critique appears since the beginning of his investigation in Things Hidden since the Foundation of the World, when Girard distinguishes between Heraclitus's logos and the logos of John's gospel.11 In Violence and the Sacred he proceeded to investigate the historical origins of both forms of logos and discovered that a hidden reality underlay the evidence of the canonical judicative structure, using the resources of Derridean deconstruction, of which Girard acknowledges his debt.12René Girard's relationship with philosophy is problematic. Mimetic theory criticizes all human cultural constructions, including mythology and philosophy. However, in The Scapegoat René Girard approaches the issue of "judgment" as a place of truth. The traditional way of understanding life, as a self-appropriating and self-organizing process of not ceasing to exist, of taking care of one's own hunger, is challenged by today's unprecedented proliferation of discourses and techniques concerning the living being. This challenge entails questioning the fundamental concepts of metaphysical thinking--namely, time, finality, and, above all, being. Garrido argues that today we are in a position to repeat Nietzsche's assertion that there is no other representation of "being" than that of "living." But (...) in order to carry out this deconstruction of ontology, we need to find new ways of asking: What is life? In this study, Garrido establishes the basic elements of the question concerning life through readings of Aristotle, Nietzsche, Heidegger, and Derrida; through the discussion of scientific breakthroughs in thermodynamics and evolutionary and developmental biology; and through the reexamination of the notion of hunger in both its metaphysical and its political implications. The aim of this work is to analyze a political concept derived from a religious myth. I will analyze both by means of the genealogical method of the mimetic violence because this genealogical method looks for the origin of concepts and myths within the human culture. Its basic assumption goes like this: the mimetic sacrifice causes the ritual sacrifice, and the ritual sacrifice causes in its turn the myth and the prohibitions. El artículo presenta los principales estudios de Juan Carlos Rodríguez (1993, 2017), Fredric Jameson (2013, 2015) y Bolívar Echeverría (1996, 1998) que abordan el surgimiento de la modernidad, su impacto en la esfera de la cultura y la subsiguiente constitución de un tipo específico de individualidad. A partir de ciertos conceptos clave, aquellos ofrecen una explicación de las relaciones entre la economía de mercado que empieza a surgir en la transición que va del feudalismo al capitalismo y ciertas disposiciones que (...) aparecen en determinados productos culturales y comienzan a considerar al individuo como un sujeto que se autodetermina libremente, lo que da cuenta del hecho de que la ideología manifiesta un carácter constructivo.
